Default Some TOS info about ViaTalk

I have had a ViaTalk line for 3 or so months now and other than some issues during the equipment upgrades over the past few weeks I've been very happy. I have received a letter from ViaTalk CS telling me that my service will be discontinued at the end of the month. The reason for this is because no one ever calls me. I only talk to a few people and 99% of the time I call them. This is a violation of ViaTalk's TOS so it seems. I understand that their TOS calls this business use but it's not. I also know that all providers have to come up with some system to separate business use from residential use. But I am not sure why this is a good way to do so. I have called ViaTalk and this is how it's going to be....

About 3 weeks ago they did some upgrades to the network and the quality of my service went down, now this....

Why do they care how many calls you get if you pay the bill each month?!?!

It has something to do with how their providers charge them....they won't go into detail....

I think that's seriously wrong...

So if someone prefers to call others than they are a business now? Haha. Start a thread at DSLreports complaining. ViaTalk reps constantly monitor that board.

Maybe we can get them to change their TOS on that. Are they gonna charge you the 50% cancellation fee?

Are they gonna refund any of your money?

Wow - and I thought their cancellation clause was bad. We had Viatalk for about 7 mo of a 2 yr contract. The phone just wouldn't work after a big maintenance upgrade they did - and none of their tech support seemed to care about fixing our problem. 10 days, no service.

We cancelled and tried to get our money back. They only gave a partial refund (half of the remaining contract) - that's their terms, regardless of whether they are even providing you a service! Our next move is Small Claims Court - might as well try.

A recent development is that they are now charging extra for the speedy customer service - that's a big flashing warning light for anyone pondering signing up. It's not worth the unreliable service with poor customer service.
